Terms of Business

1. Sales Classification – B2B (Trade) or Consumer
This agreement may fall under either a Business-to-Business (B2B) or a Consumer sale, and you must declare your status truthfully at the point of sale.
If you are purchasing the vehicle in the course of your business, trade, or profession, the sale is classified as Business-to-Business (B2B).
If you are purchasing the vehicle for personal use and not in the course of a business, the sale is classified as a Consumer sale under the Consumer Rights Act 2015.
Your classification directly affects your legal rights and responsibilities.

2. Distance Selling / Cooling-off Period
We do not operate under a distance selling scheme as defined by the Consumer Contracts Regulations 2013.
If you are a consumer and choose not to inspect the vehicle at our premises prior to purchase, you waive your right to a 14-day cancellation period.
If you are a trade buyer (B2B), you acknowledge that distance selling rights do not apply, and you are not entitled to cancel the agreement once entered.

3. Deposit/Holding Fee
Deposits are strictly non-refundable.
If you cancel after placing a deposit, it will be forfeited in full, regardless of whether you are a trade or consumer buyer.
Deposits are only accepted when you are 100% satisfied with the vehicle.
Purchases must be completed within 14 days of placing the deposit. Failure to complete will result in the deposit being retained and the vehicle being re-advertised.
Any preparation work requested prior to cancellation will be billed.

4. Payments
Full payment must be made via bank transfer only, with cleared funds received at least 24 hours prior to collection.
We do not accept:
Credit cards
PayPal
Cheques
Any alternative methods
If you are collecting the vehicle over a weekend or on a Monday, ensure payment is made by Friday of the previous week.

5. Vehicle Collection and Preparation
Where applicable, preparation works may take up to 10 working days. You will be notified of any delays.
We are not responsible for any losses arising from:
Delayed delivery
Missed appointments
Vehicle being unavailable for use
You acknowledge the opportunity to inspect and test the vehicle prior to sale, and by proceeding to purchase the vehicle you confirm satisfaction with the vehicle's mechanical and cosmetic condition in line with its age and mileage.

6. Vehicle Accessories
Accessories such as mats, SD cards, navigation software, parking aids, A/C, etc., are not covered under warranty unless explicitly stated in the advert as “in working order.”

7. Part Exchange Vehicles
Where we accept a part exchange, the following applies:
You confirm legal ownership of the vehicle, free of encumbrances, or that any existing finance can be settled.
Part exchange value is based on your description. If the vehicle’s condition, mileage, or documentation differs, we reserve the right to revise or reject the valuation.
All keys, the V5c, and service records must be provided.
Vehicles must be delivered before or on the day of collection of the purchased vehicle.
Delays beyond 7 days may result in the part exchange offer being withdrawn.
If delivery of the purchased vehicle is delayed by more than 21 days through no fault of our own, the part exchange value may be reduced by 2.5% per full 21-day period.
You are responsible for removing:
Personal belongings
Private number plates
Aftermarket parts or accessories

8. Vehicle Recovery
Park View Vehicles Ltd does not provide recovery, breakdown, or roadside assistance. You must arrange your own cover.

9. Courtesy and Loan Cars
We do not offer loan or courtesy vehicles under any circumstances. Any associated transport costs during repairs or warranty claims are your responsibility.

10. Warranty
B2B Buyers (Trade Sale):
If you are purchasing as a trade buyer / Commercial Vehicle / Hackney carriage the vehicle is sold without any warranty, expressed or implied, unless one is separately agreed in writing.
The vehicle is sold as seen, tried, and approved, and you acknowledge that the Consumer Rights Act 2015 does not apply.

Consumer Buyers:
If you are purchasing as a consumer, your purchase is covered by the Consumer Rights Act 2015, which gives you the right to:
A full refund if the vehicle is faulty within 30 days
A repair or replacement within 6 months if a fault develops
However, these rights do not apply if:
The vehicle is sold with known faults which were declared
Damage or misuse occurs after the sale.

If a warranty is provided or purchased, it is administered by Park View Vehicles Ltd We offer an in-house back-to-base warranty valid for 3 months or 3,000 miles (whichever comes first).

Important Conditions:
The vehicle must be returned to us for inspection and any repairs.
Do not drive the vehicle if a fault occurs, unless it has been deemed roadworthy.
You must obtain written authorisation from us before any work is carried out.
Please note: Our warranty does not cover:
Wear and tear items (e.g. brakes, tyres, exhausts, clutches, timing belts)
Damage caused by neglect, abuse after purchase and Work carried out by unauthorised third parties

11. Consumer Rights Act 2015 (CRA) – Key Terms for Consumers
If you are a consumer, and you reject the vehicle after 30 days under the CRA 2015:
A mileage deduction of £0.45 per mile will apply
Any costs to return the vehicle are your responsibility
Any damage or alterations will be deducted from any refund
If requesting a repair or replacement:
The vehicle must be transported to our authorised garage at your expense
You must stop using the vehicle and record the mileage at the time
No vehicle will be accepted for return without the V5c. If it is not yet available, £500 will be retained until the V5c is returned.

12. Complaints & Disputes
All complaints must be submitted in writing to:

Disputes regarding classification as a consumer or trade buyer will be determined based on:
The details provided at the time of sale
Whether the purchase was made in the course of your business
Providing false or misleading information to gain consumer rights for a trade purchase may be considered misrepresentation or fraud.

13. Final Acknowledgement
By proceeding with the purchase of the vehicle, you confirm that:
You are the purchaser of the vehicle.
You have been given a full opportunity to inspect and test the vehicle.
You accept the condition of the vehicle and the terms of sale.
You understand whether you are purchasing as a consumer or a business buyer (B2B).
You acknowledge that your legal rights vary depending on your buyer status.
By choosing to go ahead with the purchase, you confirm that you are fully satisfied with the vehicle and the terms of this sale.
